In 2010, the National Court of Justice accepted and condemned the defendants to pay a compensation for pain and suffering arising out of a breach of a hotel management contract in the case Hotel Boulebard S.A. y Predial Nueve de Octubre S.A. v Londohotel S.A. y Sociedad Comercial Hoteles Limitada. This paper will discuss that decision in light of the uniformly accepted notion under the Ecuadorian legal system that prevents causes of action for pain and suffering arising out of contractual breach.
