Abstract

This article is about the autonomous worker. Who while is protected by other legal systems, in Ecuador is not still considered under the tuition provided by Labour law. At this scenario, which is supported by several foreign doctrinal authors, understanding if under the current rules there is a legal support to protect this type of worker in Ecuador is essential. This paper will focus particularly on the study of the autonomous worker who provides personal services to a contractor, due to its proximity to the subordination regime, which deserves a protection system. This research will be approached from a constitutional level, which can be considered the legal branch that has developed a system of protection of the autonomous worker in Ecuador.
