Based on the (uncontrolled) migratory wave that Chile has been experiencing for the past decade, we quantitatively study the jurisprudence of the Supreme Court of Chile over the last 10 years, regarding the principle of due process in the expulsion of irregular immigrants. This is intended to categorize the immigration cases that have judicialized their expulsion by invoking this principle; evaluate their behavior in the expulsion of immigrants; formulate jurisprudential lines derived from this principle and analyze their effectiveness in expulsion. Thus, using a jurisprudential-analytical-quantitative methodology, we conclude that there is a predominance of the principle of due process over the expulsion of irregular immigrants in Chile.
