The article questions the validity of establishing statutory deadline or specific time periods to provide access to asylum systems. Firstly, it explains that the right to seek and receive asylum is a substantive right that compel States to identify, acknowledge and protect persons with international protection needs. It is asserted that prescriptive deadlines nullify any possibility for refugees to be recognized as such, despite facing risks in their country of origin. Subsequently, a judgment issued by the Mexican Supreme Court is used as a basis to layout some of the arguments that have been used in favor of prescriptive deadline. Simultaneously, these arguments are challenged to emphasize the unconventionality of prescriptive deadline. Lastly, the article discusses some of the consequences that these norms have had in Mexico as a warning for the region.
