Dispute Boards in Public-Private Partnership Contracts

The construction of infrastructure is a global need that calls for an efficient management of resources under a public-private cooperation scheme. In December 2023, Ecuador published the Organic Law of Economic Efficiency and Employment Generation, which in its Book II includes the Creation of the Regime for the Attraction of Investments, through Public Private Partnerships (the “PPP Law”). The PPP Law incorporates in the Ecuadorian legal system the Dispute Boards as part of a tiered dispute resolution process in Public-Private Partnership contracts (the “PPP Contracts”). This document provides definitions and types of PPPs and Dispute Boards, analyzes their interaction within the scheme of a PPP project and proposes recommendations for use that seek to assist in the formulation, development and strengthening of PPP Projects in the country.
