Inteligencia artificial en el arbitraje: avances, implicaciones y rol en la toma de decisiones

El objetivo central de este artículo es analizar la posibilidad de que la IA pueda asistir y finalmente reemplazar a los árbitros en su función resolutiva, examinando la factibilidad y dificultades del desarrollo de un AI-arbitrator y presentando desarrollos concretos de esta tecnología en la actualidad. A la luz de la Convención de Nueva York y varias leyes de arbitraje, se profundiza en la viabilidad de la ejecución de un laudo dictado por inteligencia artificial, así como la posibilidad de que este sea anulado. Finalmente, se aborda las objeciones actuales al uso de esta tecnología para la toma de decisiones, tales como las alucinaciones, los sesgos, la motivación y transparencia de sus decisiones, y además se analiza como las nuevas regulaciones podrían contribuir a la eliminación de dichos problemas y a la regulación del uso de la IA en el marco de la resolución de conflictos.
