CALL FOR PAPERS Nº 34 - IURIS DICTIO JOURNAL

The law journal Iuris Dictio invites researchers, students and faculty of law to submit their articles for consideration in Dossier No. 34 of the journal, which will be published in December 2024.

The Dossier will focus on the following topic:

“Historical continuity of legal aphorisms - regulae iuris - in procedural law”

 As is well known, throughout its historical tradition Roman procedural law primarily developed through three avenues: the first, through an archaic process called legis actiones; however, the rigid formality that characterized it led to the establishment of a new, more flexible process called per formulas that remained in vigor throughout the classic period. Nevertheless, the Principality began developing the imperial process of cognitio extra ordinem, originally reserved for certain disputes and later becoming the sole procedural means.

All of these procedures created procedural rules inherent to their different phases. From an etymological point of view, these rules were summarized in aphorisms created by those who compiled the Corpus iuris civilis and by jurists of the Law renaissance beginning in the 11th century.

Against this background, it is interesting for modern legal science to understand the origins of the procedural rules created within the Roman legal tradition, along with their effects. These rules are still applied in modern procedural praxis, some even extending into alternative methods of dispute resolution. From this perspective, the aphorisms that emerged in Roman Law form a part of common procedural Law, since they unify different legal systems spread across the modern world.

Therefore, Dossier Nº 34 of the journal Iuris Dictio, coordinated by Professor Juan Carlos Prado Rodríguez, Ph.D., of the Universidad San Francisco de Quito (Ecuador), aims to gather a certain number of doctrinal contributions that speak to the primary aphorisms created in the Roman procedural context, up until their acceptance in modern procedural praxis.

For this dossier, theoretical or doctrinal texts will be accepted, developed from interdisciplinary perspectives, as long as they are related to the indicated subject matter and are in obvious dialogue with the field of law.

Additionally, the call for papers is open to articles on diverse topics of law. These articles, should they be accepted, will be published in the Miscellaneous section. All the articles must be original and not be simultaneously submitted for consideration by any other publication.

The deadline to submit papers is June 15th, 2024. Articles must be submitted on the journal’s OJS platform, after registering as a user at the following link:
