Abstract

Speculation about a metaphysical order irreducible to individual experience is universal to the human condition, manifesting itself mainly in religious beliefs. The theoretical-philosophical panoramas structured by John Finnis and Amartya Sen are useful for understanding this phenomenon and for discerning its appropriate space in human communities. The rule of law assumes a key role in the management of this basic good, and, therefore, it must preserve the conditions of its flourishing, for which a secular posture that recognizes the social relevance of different religious visions for the attainment of the common good of human beings.
