Aesthetic injuries to the face as an aggravant of the crime of injuries in the context of violence against women

Abstract

Aesthetic injuries to the face are a type of injury that most frequently afflict women within the context of violence against women by their partner. There is a violation of their right to physical and corporal integrity, as well as an impairment of their aesthetic identity. From a legal and legal medicine approach, and with a quantitative and qualitative methodology, this work provided a specific analysis of the subjects, means, circumstances and specifically the figure of the aggravating factor, that surrounds this criminal act. The various consequences that they have in the spheres of the victim's life were also considered, as well as an indication of how reparation for aesthetic damage should be handled. With this study, the intention was to shed light on the Legislator and constitute an investigative preceding on the differentiated treatment that should be given to cosmetic injuries to the face.
